If a Donor gives his Donee(s) authority to make decisions about Donor’s property and affairs, it does not authorise his Donee(s) to dispose of his property by making cash gifts unless he specifically states so in the LPA.

Can my Donee(s) give away my money as gifts?

If a Donor gives his Donee(s) authority to make decisions about Donor’s property and affairs, it does not authorise his Donee(s) to dispose of his property by making cash gifts unless he specifically states so in the LPA.

The LPA can impose restrictions on the amount of cash gifts per year or give the Donee(s) unlimited power to give cash gifts.

At L’Avocat Law LLC, our default position is to tick the “No cash gifts” option unless instructed otherwise by clients.
